BETWEEN: Pauley Charter and Adventure Tours (Hereinafter “The Provider”)
– AND –
BETWEEN: Passenger (Person being transported to various facilities by the Provider).
WHAT IS PROVIDED
The Provider agrees to provide transportation for excursions and charter tours from the Passenger tour starting point to various tourist attractions, wineries, breweries and other facilities in Prince Edward Island as described in the tour package upon time of purchase.
RESPONSIBILITY OF PROVIDER
The Provider shall only be responsible for transporting the Passenger to the various establishments set out in the tour description upon time of purchase and shall not be responsible for any injury, harm, loss, or damage to the person or personal property of any form or type whatsoever, including death, occurring to the Passenger or the Passenger’s possessions once the Passenger leaves or disembarks from the transportation provided by the Provider no matter how same occurs.
While the Passenger is at the various establishments described in the tour package upon time of purchase the consumption of any foods or liquid (including alcohol in any form) shall be at the sole discretion of the Passenger and any illness arising there from shall not in any way whatsoever be attributed to the Provider.
RIGHTS OF PROVIDER
If, at any time, the operator of the transporting vehicle is of the opinion that a Passenger is intoxicated, uncontrollable, offensive, rude or acting in an improper manner before boarding the vehicle or while the vehicle is in the process of transporting Passengers from one location to another or back to the starting point, the operator may ask the Passenger to leave the vehicle or the Provider may request assistance of and from any other Passengers or from any Police force, emergency medical provider or any other person or persons that, in the sole discretion of the Provider, will be best able to handle or deal with the Passenger, and if necessary, the Passenger shall be responsible for all costs related to the attendance of third parties including the cost of the Passenger returning to the Passenger’s place of accommodation.
RELEASE OF LIABILITY
Notwithstanding any statement contained herein the Passenger acknowledges that the Passenger is at least nineteen years of age or older (or be accompanied by a parent or guardian nineteen years old), the Passenger acknowledges that the Passenger has read and completely understands the contents hereof and expressly releases the Provider, as well as the Provider’s employees, owners, agents, assigns or successors of and from any and all liability for any injury, harm, damages (including luggage), loss, shock (from injury or death to someone else) and death to the Passenger or anyone else no matter how same should occur or have occurred from the starting point until the Passenger subsequently arrives to or at the Passenger’s home or place of accommodation for the day of the event. This release also applies to and shall be binding upon the Passenger’s heirs, family, representatives, attorneys, assigns, or trustees.
Your Release of Liability is binding upon any Ticket Purchase.
